Default Liability for a sold car

I just sold my EF 2 months ago but the buyer has not registered the car under his name. He said the car won't pass smog. I already dropped my release of liability to the DMV. If something happens to the car who should be responsible for it? Who's the owner of the car now? Lastly, do you guys know about the law if you sold a car that can't pass smog? I need all the help I can get to get this crap over with.

Dealers must pass the smog.

You sold the car "as is" it isn't your fault the new owner cannot get it to pass smog.

EDIT: Also, I had sold a car a while back and then got a parking ticket in the mail. I did the release of liability, stated it on the ticket and never heard anything back from the DMV.

Again, it's mean to say but, not your problem.

To make matters worst, the DMV lost my release of liabilty the first time I sent it. And the buyer got a parking ticket in which the ticket was sent to me because he had not registered it yet. So I disputed it already. Damn this guy is giving me so much hassle.

I've been bugging him to have it registered and he said soon. Basically I'm still staying as the nice guy here because my *** is still registered on the DMV records as the owner. Is it true that if a car that was sold can't be smog, the state will just buy it from the owner for $1000?

not sure about the law in CA, but i dont think that's true cause soemtimes it takes very little to help pass the smog.......

just go to the dmv and tell them what happens, maybe someone can answer you there
