Default EX motor into a DX EK hatch?

I'm planning to swap in a d16y8 in replacement of the y7 in my EK hatch. I was wondering if my car will pass smog? My car is a 98 OBO2, but can I still swap in a 96-97 y8 motor to pass smog? Or does it have to be 98-00 newer? Also this is still a SOHC swap so will it pass smog, j/w. Reason why not going DOHC route is because everyones doing it and I want to keep my car in good gas mileage. Any info will help.

96-98 are all obd2a, 99-00 are 2b. edit: you need a 98+ motor though. swapping an older motor into a newer chassis is illegal.

It'll be the same obd, it will pass smog... doing a swap for 20 hp is pointless when you could just do bolt ons.

I still get 25 mpg beating the hell out of my B16 which needs a tune up, badly.

If you are in Cali, I believe you need a 98-00 Y8. It should pass smog with stock ECU. It is a USDM motor so it will pass emissions.

I don't know of any SOHC bolt-ons that will add 20 hp. He can easily do a mini me for cheaper though. I would do that if I were you.

you don't think a cam gear/cam, intake, header and full exhaust would be worth 20 horses? (i'm asking not condescending)

I COULD. But then again, I don't usually consider a cam and cam gear a bolt-on... There is a little more work put into those than a intake, header, or exhaust. Also, it depends on the parts. *shrugs* I would rather do a mini-me or slap a turbo on that bitch than do a whole swap, but that is just my opinion.
