If your 1000000% sure its not stolen, then yes by going through a lien process. But if theres a .01% that its stolen and you try it youll get into alot of trouble. No jail time but youll loose the car and whatever money you put to it.
If he was the original registered owner have him/her go down to the local DMV and order a duplicate. Should get there in 2 weeks or so, THEN buy the car.

Also the current titled owner should be able to do a quick deed on it and get the title in hand the same day for only a few dollars more (at least that's how it's done in FL)

I have the same issue. Luckily I work with the kid. In New York you have to sit at the DMV for 2 hours and show your registration and license to prove identity and they mail it to the owner in 2 weeks. I gave him half the money, and am now working on the car and when I get the title, I'll give him the rest.

To play it safe i would not give him any money until he gets a new title from the DMV. If he is the registered owner of the vehicle then he should have no problem getting a new one from th DMV.
