I had a testpipe for about a year on my Integra. It reeked like none other and made the exhaust tip brown. Got pulled over once with it on (motorcycle cop), but he didnt notice, but the cops dont really care about mods where I live. BTW it made the car really loud and I can't see how someone wouldn't notice if you didnt have one, the smell stuck to my clothes and crap.
If the cop knows or looks under your car, I imagine there is a hefty fine and ticket (probably "fix-it", or emissions violation) or they could take the car. Just dont get caught.

I love the sound of a free flowing exhaust...
Cats aren't compulsory where I live, so very few done up cars have them...
Its not as bad as you make out, and the sound is very crisp and clear, rather than the fluffy kind of sound you get with a Cat installed, hi flow or not.

i'm currently using a testpipe and i haven't noticed any smells or weird exhaust colors. as far as being busted with a high flow cat?? i don't really see how... around me cops look for big and loud exhausts...i haven't known them to ask about the cat...a high flow cat is better than a testpipe as far as being legal goes...getting busted through emissions is a pass or fail....they don't diagnose the exhaust on the spot, but they may send you to a shop that will. its pretty much do what you want at your own risk i guess.

well, i have a OBD 1 high flow cat and i had it for like a year now. but since i live in california, you think i should go back to the stock one. since california wants to be dicks about the emissions.

If I lived in Cali I wouldn't drive around with a testpipe. You can get emissions legal high-flow replacements that are CARB certified. I believe it's Carsound that makes them, they're cats that are designed to flow V-8 exhausts but are bolt-in (for certain Imports) becasue they use the factory style flanges.
