The clip would help it stay locked into the differential. I don't think there is a way for it to come off in there unless it's broken or while removing the axle you were about to break the rest of the tranny... At least, I've never heard of it happening.
Did you break one off? If you can't see and retrieve it with a little magnet on a stick thing, you may have to open the transmission up. Maybe it would fall to the bottom and be able to get it out of the oil drain...

i ask cause i just bought a 97 civic 2d with a h22 swap. the guy got tired of messing with it. he couldn't get the axle to go in. he said it drove fine then one day it had a grind when he would drive and turn. he pulled the axle and ordered a new one. every time he got a new one it it would not go in all the way. he tried beating it in and everything else. so i got the car and a new axle from innovate that he just received. its snowing now so i won't be going out side right now but when i do i wanted to know what to look for.

Look into the differential and look for a clip a little ways in. Ask the guy if the axle he pulled out had the clip on it.
And beating an axle isn't the best way to get it in. You gotta use more like a firm, quick motion. Also it seems to help having the clip open downwards.
