Calling around and asking will answer your question.

if your airbags are showing a code error, it will not pass in any state.
If it doesn;t have air bags or is by-passed and doesn't show a code error, it will as long as your insurance company is aware of it.

No they aren't, I live like 20 min from NJ, and they almost share all of NY's laws.

You can't have the SRS light on, and if OBD-II ('96+) it has to throw no codes, have no more than 2 monitors NOT ready, and respond to an OBD-II connection (OBD-I ECU's won't).

The reason they're "cracking down" on small shops with huge fines is because shops keep passing OBD-II cars by skipping around the issue, like when they need to do inspection, they punch in the VIN, and then they hook the OBD-II monitor up to a different (stock) civic. Then the stock civic registers as "OK" and it sends the signal that all is good. People keep doing that to get around it since there's no signature on each ECU, and if you take a similar car, it shares the same aspects (monitors). That's why they're cracking down, because illegal inspections. It has nothing to do with legal inspections. Before they made cars need to be scanned w/ an OBD-II scanner you could buy inspection stickers by the rolls underhand.

Call any local shop in NJ and ask them about it, and they can tell you. You can't have the SRS light on, though they don't check anything beyond that.
