Default rpm too high or a little erratic

I have a question about rpm problems on a 4gen accord (2.2L EXi A/T, 288,000km)

Some time ago the rpm would fluctuate between 1000 and 1500 every second or so, and this was diagnosed as a dirty iacv. The valve was cleaned up and everything was fine for a while. However this is what I get now:
- mostly idle speed is a healthy normal below 1000rpm but sometimes goes up to or over 1000, which means I have to floor the brake at a red to keep at a stop
- rpm while driving seems a tad too high and the car wants to surge forward
- 3rd gear seems minimally reluctant to engage... keeps revving a little too long before switching
- no CELs are thrown
- only mod is a short ram intake

I had a look at other posts, but I have not found a satisfactory solution to this problem... so the question is:
is it a faulty iacv (apparently these things do not fail, I mean this is a very simple mechanism)
or perhaps an EGR?
What to do?
Any help greatly appreciated.

How old is the intake, and, specifically, when was the filter last cleaned? I know that my friends car used to do this, and it turned out the ECU needed more air or something because his filter was horribly dirty and would therefore crank up the RPMs. Then again, I think he also got a CEL.

Check the cone of the filter to be sure the metal plate inside of it is still there. It may have been sucked into the throttle body and resting against the throttle plate.
