tial wastegate 38mm taller than tial 35mm?

tial wastegate 38mm taller than tial 35mm?
i am running tial 35mm now that i borrowed from friend. with it on my drag manifold it clear just enough but with a ipplin in the top vaccuum port it rubs my hood and actualyl cracked my carbon fiber hood lol..
anyways i have to give this tial back soon but i want to buy another one but they only sell 38mm now.. i can live with my hood rubbing now but is the 38mm wastegate going ot be worse?

The 38mm wastegate in silver will be the same size. They use the 40mm top for other colors and it is taller.
