Just got a ticket for an "Improper Muffler", any help???
 
Well I just got a ticket this morning for an Improper Muffler. It was a $110 ticket with no points. The cop (which is a fresh rookie) said my exhaust was too loud. He did not however make me rev my engine to actually hear it. Luckily I am on my one week vacation time off work right now so I can do whatever I want all day.
Went down to the courthouse a few hours later and booked a trail date. Guess who I happen to run into there? Yup, the same mofo that gave me the ticket. So I followed him into a courtroom where he was fighting some tickets that he issued. Sat down next to him, guess he was shocked to see me. hehehehe. Someone else was fighting a ticket for blue lights on the winshield washer nozzles. Cop wrote down "BLUE LIGHT ON FRONT" as the offence. Judge didn't know what to make of that since they couldn't find anything referring to that in the book, so they let the guy go. Cop was prety pissed, just stormed out.
I'm planning on sitting in on his cases this week and taking note. Anyone else ever get a ticket for an "improper exhaust" and fought it??

I got a fix it ticket for my exhaust because "it looked loud."

Sorry bro, the oppression stinks, but hey, what can we do about it?

I don't know how the laws are in Canada, but here in California, the vehicle code states that it is illegal to have an exhaust be louder than a certain decibal. Maybe in Canada, any modification to the exhaust system is illegal.

good thing you live in Canada, disputing it won't cost ya a penny.

First check to see that everything on the ticket is correct. If their is something wrong on the ticket, i.e location where u got it, or maybe he wrote the act down wrong. If their is something significant wrong point it out to the judge. They can throw the ticket out based on some flaws. (I had one ticket thrown out cause the location was wrong.)

If there is nothing wrong then when you go to court to dipute the charge. Ur gonna have to ask the cop questions when u get the chance. U have to create some doubt, and show the judge that the cop has no idea what hes doing.

Some quetsions I'd ask is

What is the recognised procedure to see how loud an exhaust is ?
Have you been trained in any special procedure to measure decibles ?
Do u have any equipment in your vehicle that detects sound levels ?
At the time of the incident could driving down an alley way have caused an echo making it seem to loud ?

etc, etc.

Oh and maybe fib a bit and tell the judge that you have been pulled over and been through roadchecks with the exhaust and no other officer has ever mentioned anything about it.

so basically go up there and be polite and ask away, give the judge a reason to throw it out.

hey if you lose ask the judge to lower the fine and to give you lots of time to pay.

make sure u ask away, I disputed 7 tickets and won em all, mainly cause cops are uncertain.

Oh and one thing for all u speeders, if a cop ever asks u in court if ur odometer has been calibrated always answer "yes"

I've had gotten 2 of those when I had my si. The first one the officer did not show so i got that dismissed and the second one i was found not guilty because the judge said that determining that my exhaust was too loud by ear was not enough evidence to find me guilty https://honda-tech.com/forums/images...es/emsmile.gif . They have too test ur exhaust, I am not sure how they do it but its determine by decibels (not sure on spelling) https://honda-tech.com/forums/images/smilies/emthup.gif . Good luck. Pray you get a fair judge.

Sometimes they can get u on a "non-OEM" exhaust and thats what the ticket is for..As long as its not factory exhaust they can give u a ticket...at least here in Va..not too sure bout up north..

In GA there is no decibel law so you are @ the cops mercy. i tried to fight it but the judge was a dick (Found out he is known to be a hard ass). I lost and they doubled my fine. If you are in Forest Park, GA and you get stopped.....just pay the damn ticket you have no way out of it.

Or go to X-Copper and fight it... 110 dollar ticket will cost you 265.. taxes in..
