Icon3 Employer hasn't given me my W-2 and he hasn't been paying taxes???

I've been employed at a construction company here in cali for 1 1/2 years and my boss was getting behind on paying me my salary so I quit. Right now he owes me around $1500 and i am having trouble getting my W-2 or 1099 from him. When I called him to get my money today he told me he's not gonna pay me and to accept it as a loss. I haven threatned to turn him into a goverment agency and he said he hasn't been paying taxes on anything i made and that there was know proof of me working for him.

He paid cash and I dont have any check stubs or any kind of proof except for one last personal check he gave me that bounced that may be the only proof to show that I was employed for him other than the employees that also worked for him. (all employees quit the same day i did).

Does anyone know who we can contact for help getting our money or atleast get him in trouble for not paying taxes? and once again he has been giving me the run around with my W-2 and tax deadline is coming up.

Under the IRS, have i been working and earning wages this whole time or am i lost in the system and was considered not working for the entire last year?

best bet is to ask a lawyer that deals with tax stuff and ask him what you can do.

you can and should file

what I meant to say is walk away from trying to get something from your ex employer. You should turn him in for not paying taxes but if you do that, you might get a whole can of IRS whoopass opened on yourself.

well this why i am posting this for the fact that i didnt know until he started falling short on paying his employees. through out half the time i was working for him i did get concerned and went up to him to tell him if he was paying taxes of our salary and he said he was and im not to knowledgeable about that stuff so we all went with it believing him. so if im not getting a w-2 r 1099 from this guy then what am i supposed to do? am i being considered self employed for the last year?

Since you and your former employer have essentially been dodging taxes, the only natural outcome that I can think of is arson. One can of gasoline, one box of matches. You're in CA so houses are mostly wood. gogogo

i knew this kid in the same situation. He just walked away, Not before going to the employers shop and starting every truck at near 1 am and turning every radio up as loud as possible then left.

damn skippy i can care less about the 1500 i have already started a new job where everything is done legit and im happy for that but who can run from uncle sam ? i have to do something to protect myself plus the list of bills that i need to start paying off this year will be gruesome

what you do is tell him you have already gotten a tax lawyer and have agreed with with lawyer about paying some back taxes. Being that you cant prove pay stubs, say you can prove with bank deposits. The IRS isnt stupid they can put togeather income easily. They will pull his bank account records. You scare the **** out of him. Tell him he better give you the 1500.00 or its on.

Alot of people get payed cash every year. Its called a 1099. YOU SHOULD HAVE KEPT RECORD OF WHAT YOU MADE. He is STUPID if he dosent claim it because it cost HIM more!

If you are getting paid as a self-employed individual (1099-misc) YOU are required to pay the employment taxes. So do you know if you are considered a employee or self employed? What do you check stubs say, is he with holding anything, are taxes taken out?

I can help you but I need more information..

That is what I am wondering. Was he actually taking taxes out? So was there roughly 15% missing from your check for state and local taxes. Even if it was in cash you should know how much you were being paid per hour. Add all that up and subtract 15% (ruff guess) and if the hours multiplied by hourly pay-15% equal your take home. If he never took the 15% out then I would just keep quite and not file taxes. You will owe A LOT more than 1500.

Keep in mind, if he is self-employed than he can deduct one-half of his self employment taxes FOR AGI. Also, he deduct against his income any ordinary and necessary expenses incurred in his employment(i.e. car expenses, tools, etc....)
