If I were you I would disclose NOTHING about your history unless they require your signature to consent to a background check (in which they probably won't hire you no matter how honest you are).

See a lawyer about expungement. Shit sucks. My situation is frighteningly similar to yours, though I've got a great job currently.

* Criminal history. In California, criminal histories or "rap sheets" compiled by law enforcement agencies are not public record. Only certain employers such as public utilities, law enforcement, security guard firms, and child care facilities have access to this information. (California Penal Code 11105, 13300) With the advent of computerized court records and arrest information, however, there are private companies that compile virtual "rap sheets."

Employers need to use caution in checking criminal records. Information offered to the public by web-based information brokers is not always accurate or up to date. This violates both federal and California law when reported as such. Also, in California, an employer may not inquire about a marijuana conviction that is more than two years old.


What Is Included in a Background Check?

Background reports can range from a verification of an applicant's Social Security number to a detailed account of the potential employee's history and acquaintances. There is even some evidence that employers are now searching popular social networking Web sites such as MySpace and Facebookfor the profiles of applicants. An October 2007 survey from Vault.com found that 44% of employers use social networking sites to obtain information about job applicants while 39% have searched such sites for information about current employees. Here are some of the pieces of information that might be included in a background check. Note that many of these sources are public records created by government agencies.

* Vehicle registration
* Credit records
* Criminal records
* Social Security no.
* Education records
* Court records
* Workers' compensation
* Bankruptcy
* Character references
* Neighbor interviews
* Medical records
* Property ownership
* Military records
* State licensing records
* Drug test records
* Past employers
* Personal references
* Incarceration records
* Sex offender lists

Reduced to a misdeamnor and you are still having problems? Misdemeanors are petty and i cant see many places turning u down for a misdemeanor.

I am in the process of dropping my felony to a misdemeanor and it's not a "wobbler" like yours so it is a pain in the *** to do especially w/o a lawyer. Im going for a CPA or MBA so Im definitely going to need to clear my felony.

You should look into the certificate of rehabilitation. It's better than lowering your felony to a misdemeanor or expungement from what a lawyer told me.

the arrest is a felony and will show as a felony arrest. the actual crime has been reduced and this is where he should explain himself.

still, after 5-7 years depending on the state the background checks aren't suppose to count. no idea if the hiring party actually follows this rule, or if it's a law? chain stores are probably scared of you since they run the risk of negative media attention if you were ever to do anything. most everywhere besides chain store retail, law enforcement or education should be a go for job hunting i would think.

Lawyer quoted me $1,500 to reduce my felony to a misdeamnor and $2k for a certificate of rehab. Im trying to represent myself now and drop my felony to a misdemeanor.. it shouldnt be too hard since the plea agreement stated that i could drop my felony to a misdemeanor after successful probation which i completed a few weeks ago. I still got about $2k of restitution fees to pay before I can get it done though.

I got caught when I was 18 too. If it was just months earlier I probably wouldnt be sweating this bs right now. everybody deserves a 2nd chance

It depends what you did. Assault with a deadly weapon is a serious crime.

I'm pretty sure he's referring to a 2nd chance AFTER you "do the time".

It's just shitty that the REAL badasses out there, the ones who are most likely to commit another crime after their release, are generally the ones who have the least to lose throughout the whole ordeal, as they don't run background checks for being a drug dealer, car jacker, or copper thief. It's the people who made that one mistake, and who are well educated and otherwise fully capable of a good job, who get the most screwed.

Unless you're a professional at something, chances are that they won't want to deal with it. Skilled laborers are hard to find.

some small businesses. I hired a long time buddy who has three felonies, I know that all three are Honda-related (which my business has nothing to do with hondas) and exaggerated... and he's actually a very good guy. Very business-minded type of dude, very reliable.

My buddy runs a biz, he has an employee with a felony who is actually a very clean cut guy and a hard worker, he just got caught throwing a computer screen off a bridge when he was 18 and got a felony for it.

that was what my lawyer (who represented me years ago for this case) quoted me for a possession of narcotics for sale charge.. I dont think assault would be as difficult to erase from my hours and hours of research (remember im trying to be my own lawyer now)

I have a felony theft and a few misdemeanors and have never had a problem. I work in electronic security and was even able to get sheriff cards, consumer affairs card and got a hand gun all in California. I highly doubt a felony on your record is whats keeping you down.

Damn it I should have made myself more clear. I am not disclosing that I was convicted of a felony I am disclosing that I have a misdemeanor on my record and its still a bitch to get a job. I worked for the government as a student worker when i was 17 and got hired full on when I graduated high school as a clerk and have soon moved on . Trust me at this point as even with a decent education I am willing to work an extra job as a pizza delivery guy trust me. I'm going to try every way shape or form to get a second job just to back me up for the future. I tried costco again hoping I get a call back;;; sigh: if anyone has anythign in the los angeles I will gladly work for you no bs as long as it is part time.

Aren't you Mr. know it all pc security guy? I think that you will be better off finding some clients on the side and doing some computer work. I am sure you can make more money that way anyways. Plus, you don't need to tell anyone that you are a felon.

It's not patent to me that he even has a felony record. It seemed to me that he had a felony arrest but he was convicted of a misdemeanour offence.

I think that what's keeping him down is his own paranoia about trying to do the right thing by any prospective employer.

Papa Johns International will not hire convicted felons, but the franchisees will, depending on their needs and the suitability of references. We cannot have people on the lists of sex-based offences because of the variety of contact our employees have with all kinds of people while the employees are unsupervised.

But...there are convicted felons in the system, including some in fairly high positions in the franchise system, and that includes a very big franchise in which the founder is the major stockholder.

Nobody wants you down for life, and people will make intelligent decisions based on their needs and your capabilities.
