Whats up guys, ive been screwed over by a member from here who use to be a honda owner i guses and switched to subbie. He dicked me over. He is being a little *** and not responding to me. Only reason im posting here is because he has some horrible communications and hopefully you guys can help me out here ... (Its amazing what google can come up with on people and where they have been on the internet)

Im new here and dont knowwhere this goes, im posting this in the most highly viewed forum though.


So i bought this nitrous kit on ebay from a guy in Fredrick, maryland off his car (he said it was a wrx). 558 dollars was paypalled to him 3-4 days after.

I got an email on the 17 stating that he was unable to ship the item out until monday due to some personal problems, and he will provide me with a tracking number on monday (20). (I need this kit by tonight, the 25 for a car show)

So low and behold no email so I email him back the following emails in regards to no tracking number, not calling me, and not recieving my kit

ME: THURSDAY 16
"Hey whats up .. jsut wondering if you sent the nitrous kit out yet. Please let me know when you do and provide me with a tracking number. Please call me when you recive this email, i sent you 558 dollars i believe through paypal.

You said you would send me a tracking number when you shipped out, yet i havent recieved one yet ... so you can understand that I am getting nervous. Please respond to me ASAP

"Ok, ive been trying to keep my cool. I sent you the money over a week ago now. All I've heard is that you will ship it monday and will give me a tracking number when you do. That was last friday. I still have not heard from you. I really do not want to have to have to take matters into my own hands. I had to withdrawl my submission to the car show because this kit was not here this week.

If you do not plan on sending the kit and are going to keep my 560 dollars, just straight out tell me. If that is the case then I will have my lawyer contact you.

I understood that you had some sort of emergency last week, but this is kind of getting rediculous with the lack of communication.

This is the last attempt I will be making to contact you about information regarding the Nitrous Express Kit I purchased almost three weeks ago on eBay. You have not yet sent me a tracking number, responded to my email's, and subsequently I have not received my nitrous kit. If you fail to reply to this e-mail, a written letter will be sent to you. If you do not wish to reply to this letter or make any attempt to contact me, I will be taking this issue to small claims court, and my attorney or myself will be contacting you. Just to notify you the costs that you will incur if you do not wish to resolve the situation are the following; $558 Nitrous Kit,$30 Car Show entry, Attorney Fees, Opportunity Costs (Ie. Having a nitrous kit vs. the current to date time of the lack of a nitrous kit), and of course Time Costs (ie. Taking time out of my schedule to file a small claims case, contact my attorney, and interruptions of classes). These costs are in the area of 2000 dollars, possibly more.

If at that point you still do not wish to comply, I will enact the Better Business Bureau, Paypal, eBay, and the local Police Department to reconcile the situation.

Once again, I have given you ample time to respond and ship out my item. A winning bid between a seller and buyer is a legal binding contract, and breach of this contact is subject to litigation.

A written formal letter will be sent out if there is no response to this e-mail notification within two business days; October 1, 2004. Govern yourself accordingly.

"Hi Sam,

Well I just got the package in today and Im outraged and pissed !!! Let me just start that you didnt get the freaking package out on Friday, thats the first thing. Second thing is your missing a few rather important items that you said were INCLUSIVE IN YOUR AUCTION. 1.Remote bottle opener 2. Various jets supplied with the kit 3. "GAUGE ON BOTTLE" 4. Fuel pressure safety switch. This is only the initial stuff that I noticed upon a quick glance, as well as hardware . Thirdly I paid for Nitrous Express components, whats the deal with this NOS garbage you sent me? Also the blow down tube is bent. And on top of the that the solenoids and purge valve brackets are bent. I believe the nitrous feed line is missing or its been cut into three different pieces There is missing hardware. And I have no idea what this Monster Cable thing you sent me is. NONE OF THIS WAS MENTIONED IN YOUR AUCTION.
You stated it has a GEN X2 kit ... hmmm I only got roughly 3/5 of those components ... and the nitrous express purge ironicallu mutated into NOS ... hmmm go figure on that one ... (Im missing abuot half the stuff in the third pictyure on your auction).

I put up with a lot of **** from you getting this package to me three weeks after I paid you and now you are pulling this on me. I dont know where you are coming up with the nerve to do this. Im not some little punk *** kid that idely stands by while hes getting raped in the ***.I suggest you make things right by either ordering all relevant missing parts and replace the NOS part and having them overnighted or buying back your kit and including shipping and an additional 50 dollars additional for all the **** ive put up with and the time i have to take off of work, school, and my team practice in order to go back to the post office and send it back out. (Your looking at close to 675 dollars + paypal fees). I much rather you buy the kit back.

I suggest you take IMMEDIATE action.

i will assume you didnt pay using your credit card? if you did, get in touch with your credit card company and explain the situation with them, and that you can provide all the evidence to prove your case. they will take the funds back (or put a notice of balance due on his credit report history) and will deal with paypal and paypal will freeze his account and send him a balance due... but if you went through your bank account which most do. then you possible only option is to take him to small claims. im sure now you realize paypal is just a moneytransfer service and has only now started with insurance which you have to pay for to get

yeah, um, hopefully you learn that people on ebay without ANY feedback is incredibly STUPID to buy from. there are so many scammers on ebay its just rediculous. what used to be an awesome way to sell and buy things is now an easy to to get yourself in huge trouble for fraud and to screw others over in teh proccess.

did you use paypal? what method of payment was it?

if it was paypay transfer by bank or credit card, i would call them and adives that you never recieved nothing and would like to stop the transaction or void it out..

it seems like auction ended a month just today, i would report paypal fraud if you paid that way..

If money order make sure you still have the "stub" i guess .. proof of money order to him..

I live in Frederick AND know of this kid. Jamie and Drew you probably know of him too. He was friends with that riced out blue Si with airbags and he bought Jeremy Hefner's red EG hatch and had Inline Pro do a head package on it, then sold it and bought Jinxproof's bad *** Turbo XS WRX. Then proceeded to plow through a corn field and wrap it around a tree or something of that nature. It's the kid Gabe was going to buy all that stuff off of his wrecked car.

I don't know where he lives or what his phone number is, but I have contacts that do.
