Default 2011 Crv tranmission

i have a 2011 crv with 40k on it. I have had it since new. I have been having some transmission issues. The car up shifts and down shifts very poorly. This only happens once in awhile ( 2-3 times a day ). I am a very OCD person about cars. So I am always up to date on services with the car. The cars first transmission flush ( done at local honda dealership ) was done at 28,426 miles. I have read about doing drain and fills. So I have had 2 drain and fills ( 3ish quarts ) done since the flush. This was also done by honda. However I seem to be having a issue with honda making sure the tranmission is full. I have had to take it back twice now for them to fill it up more. It was on the bottom line. I check the tranmission fluid 30 seconds after the car reacts operatin temp ( when radiator fan comes on ) but before 90seconds as the Manuel states. I checked it today but due to it being extremely cold out I couldn't get the car to operating temp ( radiator fan wouldn't come one after 15min ). Has any one else had any transmission issue? I notice it the most when the car goes to shift into 2nd sometimes. It's not super smooth. The worst is when I come up to a stop and then go to pull out immediately. Kinda of like a " California roll". The car seems to not down shift into 2nd in time. So when I hit the gas it jerks down into gear. I also have a issue when getting on the highway. I also enter the highway on a declining exit. I will get up to the speed limit ( 60mph ) and the car won't shift into over drive. It will stay stay at 3,000 rpms even after I am don't accelerating. Then after a minute it will rev up and jerk into overdrive. Any help would be appreciated. I can not recreate these issues for the local honda dealership. ( they only drive it 5 miles or so and say it's fine ) I was think about doing another drain and fill tomorrow to see if that helps.

Has the transmission update been performed? S/B 11-050

It is annoying but at the same time you have to look at it from our point (technician). If we can't duplicate the problem and without any doubt prove there is an issue there, we cannot just change a transmission under warranty. If we send the unit back and Honda checks it and finds nothing wrong with it, they will charge back the dealership. Now you can see why the technician maybe hesitant, it's not that he doesn't believe that you're having a problem but if he can't prove it and changes a good part it's bad on him.

When you have the issue, take notice of the day, Temperature of the car, outside temperature, driving style, light throttle, hard throttle, medium throttle...pin point everything and keep a record. If it only happens after 30 minutes or so after driving, if you pay the technician for a drive cycle (usually an hour at the labor rate they charge at the dealership) he will drive the car for the hour and if he can recreate the issue I'm sure there will be no issue to repairing the car.
