Brake lights not turning off?!

Brake lights not turning off?!
So on the car (97 civic ex) the brake lights will stay on all the time while driving and parked.
I took a look at the switch and the pedal and found this.
You can see there is a gap between the pedal and the switch and the switch is turned all the way out. The switch works and is not busted at all its just there is too much of a gap for the stopped to hit the switch. I found out the old own had placed these little pads on there to get rid of the gap but they fell off and were useless.
any info or help would be great.
I looked at my daily driver (98 civic lx) and the switch has plenty of room to still be turned and the gap is non existent there.

looks like the bracket that holds the pedal position switch may be bent? that or a wrong switch that is alot of gap
