Kid instead goes to get a refill
Employee fills cup and hands it to the kid
Kid spills it on herself

The first one was complete BS but this one I don't know so much.

I got burned badly by coffee as a kid.

I dealt with it.jpg and didn't sue.






the Public should sue the grandma for letting a 4 year old out of her sight long enough for that to go down.

I put my hand on a hot iron as a kid, got the whole "your skin is ruined for life" bullshit. Hand is fine, it healed. Didn't sue the iron makers or my parents, kids are stupid and hence you have to watch them like hawks

They do serve the coffee too hot but people are dumb. I say McD's cover medical expenses and leave it at that. Fair enough from my view, the kid was still the one that spilled it top or no top

I think at most they should be entitled to medical compensation. The punitive damages is pretty BS. That pretty much is never awarded if the injury was not done on purpose. This should be a small claims cast at best.

Solely on the fact that I don't think there is a reasonable expectation for a 4 year old kid to be capable of carrying something that could potentially injure themselves, I would award them the maximum amount permitted in small claims court, which is maybe 3000 to 5000 for all medical bills and relevant pain and suffering, then send the grandma to parenting school (do those exist?). If my neighbor's 4 year old kid asked me to borrow a pocket knife I wouldn't give it to them. But a 4 million dollar lawsuit is complete BS, it seems like they are obviously blowing up the case to cash in.

I'm not saying I would sue mcdonalds (I wouldn't even think about taking my kids to eat garbage like that) for something like this, but just for a worst case scenario.

+1 Agree.

Yet the high sodium and saturated fat content, trans fats, and refined sugars don't get a mention in this article, at all.

More Americans die of heart disease every year than die of hot coffee -- YET, we're discussing hot coffee and not death by heart disease/unhealthy lifestyle.

Original post is agenda driven (while probably well meaning) and a total non-issue until this is addressed.

Well, the child that was burned by the coffee certainly didn't chose to be burned (agree with you).

Likewise, the child who is now nine years old, has atherosclerosis, and was fed McDonalds six days out of the week by his/her parents also didn't chose to succumb to heart disease.

It's a sad state of affairs but a second coffee incident seems rather benign when compared to the *epidemics* of childhood obesity and early coronary disease, and the FF industry is certainly not helping.

People often look at the "awards" paid out in these cases from the wrong perspective. Often times it isn't the court actually awarding the complainants based on their injuries or damages. It is them PUNISHING the corporation in a manner that will actually affect said corporation into enacting change. Let's say that some big corporation was doing something really shady and potentially dangerous in all of it's stores across the nation. They slip up and someone gets a minor injury. Maybe it is only a few hundred worth of stitches, no permanent damage, no big deal. HOWEVER, the courts find that although this particle incident didn't cause any major problems it revealed a corporate wide "cover up" of them basically cheating the system or doing some other bullshit. In order to punish the company the fine them a few million or so and as how it normally goes who ever filed the initial case ends up getting the money. Saying "Hey just pay $500 in doctor's bills" to a multi billion dollar corporation doesn't mean **** and basically ensures that they can keep doing whatever the hell it was that they were doing before. Let them know that they'll be fined a few million every time they are caught and it might change their tune.

I also use to be against the payouts on many cases when I didn't understand this process but after looking into several cases that I use to think had idiotic payouts I now agree with many of them because they really aren't payouts at all. I can't remember if the old McDonald's case is one of them but it is something to keep in mind.

I agree with corporations being able to absorb these legal costs with no dent in their accounting gives no incentive for them to improve business practices since there are notorious cases where manufacturers opted to pay settlements to litigants because it was more cost effective than a nationwide recall. But I can't shake the thought that lawsuits will increase if we convey the idea that every lawsuit is a potential jackpot. Maybe there is a non monetary way to punish corporations and offering reasonable compensation to victims.

I think with the 1st coffee case, the final amount was settled out of court which was never made public.

The first one was a reasonable suit, imo. Coffee shouldn't cause burns like that. This one is not reasonable.
