Default How does unemployment insurance work in CA? I just got laid off an hour ago.

I just got laid off an hour ago from my job in sunny southern CA. It was really out of nowhere, they also let around 30 others go too. Can anyone that has been through this give me a quick summary of how unemployment insurance works? I have never been through anything like this and I'm still in disbelief. Are they suppose to notify you that you are being laid off in advance?

This is my first job since I graduated and I've only worked here for 4 months. What percentage of my previous wage will the insurance give me? How long can I file for unemployment insurance?

If you have any other words of wisdom, please share. And for all of you that have a job you hate right now, just know that any job is better than no job. Thanks.

*Looks like getting that s2000 will have to wait.

Sorry cant help you with info on unemployment, I was laid off a while back but found a job with in a month, so keep your head up.

What industry were/are you in?

Wow man that sucks. I really have no idea on the CA unemployment stuff..

BUT.. as a small consolation.. you could hop on the ChaCha bandwagon.. make a few hundred bucks a month at least.. better than nothing..

Accounting. It's weird because the tax deadline is coming up too and they need people for overtime everyday. I figured they would start letting people go after the tax deadline. The rumor at my old workplace is that they're going to cut more people tomorrow.

Just apply for it online, they'll send you some papers and give you a call, but I think CA unemployment insurance is on hold right now because I still haven't received mines, it's been two months...

Nah man, I've been laid off twice, the first time I showed up to locked doors with a sign posted, the second time there were 3,000 people casually sitting at their cubicles working on four levels of an office building when we were locked out of our system, so everyone stood up and saw a fat lady with a xylophone telling us we got laid off. This chunky bitch hit the bottom level first, then moved her way up to the top and security came to escort us out level by level. Since you only worked there for four months, I'm guessing that you'll get unemployment checks for around four weeks tops. I would suggest looking for another job and not even bothering with unemployment if I were you because of your short employment history with the company.

Unemployment isn't money that the government gives you.

It's your money that they take out of your taxes each paycheck.

Then when you get unemployment half comes from that tax money you payed into your unemployment fund and the other half comes from you last employer who laid you off.

It's not welfare. Unemployment is your money that government has just been holding in an account and collecting interest on that you will never see.

The maximum rate I think they give you is $450.00/week and it is based off what you were making. The state is dry, but last I heard they were borrowing ADDITIONAL money to keep it going.

As far as where it comes from. It does NOT come from YOUR check. Your employer is the one that is paying part of it every pay period. The only thing you and your employer both pay (at the same rate) is medicare and FICA. The employer pays the unemployment tax.

But w/ only four months of work, I highly doubt you will get much. What was your position specifically and what did your company do?

This depends.

If he was working steady before he should get decent. Figure how much you make a week and it's usually about half that is what you get from unemployment. Usually it's up to you whether you have them take taxes out of the unemployment or not.

This is think is bullshit cause it's tax money you paid in and now are getting back and being taxed on it again.

Depending how long you're on unemployment and how much you work in the year if you don't have them tax the unemployment you might end up owing but you usually have to be on the unemployment a lot and not work.

I was on unemployment for 8 months and worked 4 months and I ended up owing $200 when I did my taxes.

Anyway if he worked for say a year at another job but only 4 months at this job and got laid off he'll still get decent unemployment but if his only work history was that 4 month job he's probably SOL.

This is wrong.

If you are laid off that means they were just let go due to no fault of your own.

If you were fired it is because of something you have done negatively. You can be fired and collect unemployment, yes but if you are fired you can also not get unemployment.

Like how I stated above when you collect half is from money you payed in through your taxes to your unemployment funds the other half comes from your previous employer who let you go.

If you were fired for misconduct, theft...something like that they have the right to deny your unemployment claim since they are paying half.

You can then appeal that denial and speak to someone, usually a mediator who works for the unemployment office and lay out your side of things. They will then talk to your former employer and then make a decision. If they can not get in touch with your former employer on the set date for the appeal(usually a phone interview) then you win the appeal by default and they can no longer put in a refusal.

Being laid off you can get unemployment and the employer has not right to deny your claim since you were not fired for any fault of your own.

It's something haha. Since they pay you as an independant contractor, its untaxed so the gov't has no real record of you being employed at that time. You just pay the taxes at the end of the year when you file. You can collect unemployment and make a few bucks doing that to help make ends meet.

thanks for the link. yea, i only worked for 4 months and this was my first job after graduating. I was working an entry level position and I reviewed W4s and I9 files, did some data entry, and other basic accounting duties.
