Default LEGAL ADVICE from fellow users UPDATE

UPDATE, went to court this morning, didn't get a lawyer, talked to a few respectable traffic lawyers they said basically they cant really do a whole lot and were honest that for the money they charge they wouldn't get me results that would prove worth while, they gave me a couple tips. The prosecutor was kinda douche he basically told me my options, said that if i wanted to fight it that he would recommend jail time to my sentence along with the fine. So i got shafted 750$ and 3 points off my license. Ill take it as a steep learning curve. Dont be stupid because that one time is all it takes. Next time your ripping through the gears on city streets think twice, you never know who's watching.

A "friend of mine" was recently arrested with his good friend for excessive speeding. The "friend of mine" knows he's an idiot and jeopardized many things when he "commited" this wreckless act. The ticket is for 100mph in a 45mph zone. The friend is in a technical school and is worried about his future driving record. The police had made a few mistakes I believe. They did not read the miranda rights before arresting and questioning, wouldn't show the radar gun showing the speed he had clocked. the 100mph was very questionable. "my friend" knows damn well he was not doing 100, more like mid to high 60's. What should " this friend" do? He is very worried right now and needs some legal advice. Please dont put any negative comments. Just advice/help/opinions. Thanks motorcycle honda-tech

When I got a reckless I spent $1500 got a lawyer and got off. Its pretty easy too get off on traffic tickets if you have a lawyer.

yeah that is what im thinking i had a big epiphany the last week or so. Its time to grow up look at my future, stop living day to day or even week to week, get my **** straight.

How much do you think a typical lawyer for this traffic incident would cost? Spending 1k is well worth it since it could hinder many things such as insurance, job placement, my value to companies due to insurance costs, ect.
Should i shop/call around?

You can try too call around but i found they wouldnt give you a quote over the phone. I had too go too their office talk too the lawyer and then he told me how much.

cool deal ill start the process. man if only i realized i needed to be more cautious and mature i could have saved my *** big time.

yeah exactly live and learn my friend

its just so hard no to speed on motorcycles for me i was always fine with cars, no tickets no accidents

That's what trackdays are for. Either dragstrip or roadrace.

anything 20 over the speed limit is reckless driving. he can lose his licence/impound etc. best bet is to get a lawyer to reduce the charges to only fines/community service. GET A LAWYER

does the ticket say anything about 100mph and verfied by radar/lazer?

ticket says 100mph by radar, i was told in Arizona if they radar you and you ask to see it they have to show you but im not sure how true that is. I called around today gotta find some traffic lawyers

unfortunately you will probably have to bite the bullet on this one. you have no proof that you asked to see the gun and you have no proof that he didn't show you it so in the end its your word against his. when fighting cops in court you will find that 99% of the time the judge will side with the cop.

simple answer is to get a lawyer, go to court, pay the fines and go on with life knowing that you made a mistake and learned from it. I too have been in your shoes, i received a street racing ticket in my car and it was impounded. save the speed for the track because it will likely save your life. hell, you may get to court and the cop may not show up and it will be ruled in your favor and you will walk out with no charges, it happens quite often.

bottom line is to just get a lawyer, be extremely careful especially until after your court date because if you go in with two tickets even if its for 10mph over the judge will NOT be friendly at all. be careful, be smart, slow down, get a lawyer and learn from your mistakes. It sounds like you have based on your responses, trust me all it takes is one ticket to switch your perspective. good luck to you.

Thanks Type R, i have already starting on the lawyer situation. I went and requested the police report be mailed to me so i can discuss the case with the lawyer and see where I stand. I have definitely learned my lesson already and I have not seen the aftermath just yet. Foolish and stupid it was but learning from your mistake is the best thing you can do.

my father had spoke with a few lawyers and hes almost thinking getting representation isn't going to be worth it in this case. I feel that being represented by a profession lawyer is alot better than going alone from a judges aspect.

Personally, going in there by yourself is like stepping into a lion's den. Get a lawyer and have him/her help you out. Preferably look for a traffic lawyer in the phone book. I had a street racing ticket for going 90+ in a 35 mph zone (industrial area) followed by making an illegal u-turn without a signal and i got off by just paying a fine. Get representation you will need it, otherwise your insurance is going to shoot through the roof or may even drop you making it that much more difficult to get to work, the store, or anything. It's going to cost a pretty penny but as long as you learn from it then its all worth it.

make sure u ask to get a print out of there radar calibrations for that and the past couple months. Try and get pictures of where the violation took place the posted signs anything that can prove ur werent doing that speed.

I told the judge how its harder to stop a motorcycle that it is a car and that if i was traveling the speed the officer said i would of ran the light, so do what ever it takes man. GL

I just got a speeding ticket 65 in a 45 and fought it and got the speed reduced to 55 the cop straight lied but still.

correct me if im wrong, but some cop once told me that if a blatant crime in progress (i.e. 100 or 60ish in a 45) is witnessed then miranda rights arent necessary and that they can just arrest. could be completely wrong, but i feel like i heard that somewhere

yeah money is only money, its my job potential and points off the license that suck, fine coulda been worse or additional jail time.
